Accepatable Usage

The following sets forth Panaserve's policy on usage of it's Web servers by it's Customers. Violation of any part of the policies set forth here may result in account deactivation.

Panaserve does not allow content, or links to content, of the following nature to be stored or published on it's web servers:

Content of an illegal nature
Pirated software
Content of a slanderous or libelous nature
Content of a pornographic, or sexually explicit nature

Customers posting any of the above content on their sites will be notified by phone or by using the Customer's email address on file, and given a 24 hour period to make any corrective actions. If no corrective actions are taken, Panaserve reserves the right to suspend, or permanently deactivate the services of the Customer's hosting account without refund of any fees paid by Customer up to and including the date of notice of policy infraction.

Panaserve does not allow mass, unsolicited email messages (also known as SPAM) to be sent by customers from our Web servers. Customers sending unsolicited email messages from our system, or through other systems with messages referencing their website, may have all of their services suspended. Panaserve will inform the Customer of the violation by phone or by using the Customer's email address on file. Repeated violations may cause permanent cancellation of services without refund of any fees paid by customer up to and including the date of service cancellation.

Customers found using our system for illegal activities, including but not limited to the follwoing, will have their services permanently deactivated without refund of any fees paid by customer up to and including the date of notice of policy infraction:

Credit card fraud
Breaking in to remote systems
Threats
Disrupting network service
Vandalizing digital content on Panaserve or third party servers

Actions

The failure by a Customer to meet or follow any of the Terms of Service is grounds for account deactivation. Panaserve will be the sole arbiter as to what constitutes a violation of the Terms of Service. Panaserve reserves the right to remove any account without prior notice.

Liability

Panaserve customers agree to indemnify and hold harmless Panaserve from any claims resulting from the use of our services that damages them or any other party. The Panaserve service is provided without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Panaserve expressly disclaims any representation or warranty that the Panaserve service will be error-free, secure or uninterrupted. No oral advice or written information given by Panaserve, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Panaserve and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the services.
